These Terms of Service ("Terms") constitute a legally binding agreement between you ("Contractor," "you," or "your") and Tavatrack LLC, a Wyoming limited liability company ("Tavatrack," "we," "us," or "our"). By signing up for, accessing, or using the Tavatrack platform (the "Service"), you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
Tavatrack is an AI-powered receptionist platform for trade contractors in the HVAC, plumbing, and electrical industries. The Service includes:
All onboarding is performed manually by Tavatrack staff. There is no self-serve signup. Service begins after successful completion of the onboarding process and verification of all system components.
You must be at least 18 years of age and have the legal authority to enter into contracts on behalf of your business. By registering, you represent that all information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials.
Tavatrack offers three subscription tiers, billed monthly:
A one-time setup fee may apply: $500 (Starter), $1,000 (Professional), or $1,500 (Business). Setup fees cover personalized agent configuration and onboarding. Setup fees are non-refundable once onboarding has been completed.
Minutes used beyond your plan's included amount are billed at the overage rate: $0.15/min (Starter), $0.12/min (Professional), or $0.10/min (Business).
Optional add-ons are available at the following monthly rates:
Contractors who pay annually receive the equivalent of two months free. Annual pricing is offered after an initial monthly subscription period at Tavatrack's discretion.
Fees are billed monthly in advance via Stripe. By providing a payment method, you authorize Tavatrack to charge your method on a recurring monthly basis. All fees are non-refundable except as expressly provided in these Terms or required by law.
As part of the Tavatrack AI Receptionist Service, Tavatrack will send automated SMS text messages to the mobile number you provide. These messages include:
Message frequency varies. You will receive one SMS per captured call event. During high-volume periods (e.g., peak season), you may receive multiple messages per day.
Message and data rates may apply. Contact your mobile carrier for details.
You may opt out of SMS notifications at any time by replying STOP to any message. After opting out, you will receive a final confirmation message and no further SMS alerts will be sent. Opting out of SMS does not cancel your Tavatrack subscription. To re-enable SMS notifications, contact support@tavatrack.com.
For help with the SMS program, reply HELP to any message or contact support@tavatrack.com. We will respond within one business day.
Tavatrack's SMS program is available on all major U.S. carriers. Support is not guaranteed for all MVNO carriers. Tavatrack is not responsible for undelivered messages due to carrier issues. Carriers are not liable for any delayed or undelivered messages.

You agree to use the Service only for lawful purposes in connection with your legitimate trade contracting business. You agree not to:
There are no long-term contracts. You may cancel your subscription at any time by contacting Tavatrack at support@tavatrack.com. Cancellation takes effect at the end of the current billing period. You will retain access to the Service through the end of your paid period.
Tavatrack reserves the right to suspend or terminate your account, without prior notice, if you violate these Terms, fail to pay fees when due, or engage in conduct that we reasonably determine is harmful to the Service or other users.
Upon termination, your AI receptionist will be deactivated and your Twilio phone number may be released. Call data and transcripts may be retained by Tavatrack for up to 90 days after termination, after which they may be permanently deleted.
When you refer another contractor who becomes a paying subscriber, both you and the referred contractor will receive one free month of service. Referral credits are applied to the next billing cycle and have no cash value.
All software, AI models, workflows, templates, and content comprising the Tavatrack platform are the exclusive property of Tavatrack LLC. Your use of the Service does not grant you any ownership rights in the platform. Call transcripts and lead data generated from your callers remain your business data, subject to our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TAVATRACK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL CALLS WILL BE CAPTURED SUCCESSFULLY. AI-GENERATED CALL SUMMARIES AND SCORES ARE PROVIDED FOR CONVENIENCE AND MAY CONTAIN ERRORS. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING LEAD INFORMATION BEFORE TAKING ACTION.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TAVATRACK'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO TAVATRACK IN THE THIRTY (30) DAYS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL TAVATRACK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR MISSED BUSINESS OPPORTUNITIES, EVEN IF TAVATRACK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless Tavatrack LLC and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or any claims by your customers related to calls handled by the AI receptionist.
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in Wyoming, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
Tavatrack may update these Terms from time to time. When we do, we will revise the "Last Updated" date and notify active subscribers by email at least 14 days before changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tavatrack regarding the Service and supersede any prior agreements or understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
